Pleasantville Posted May 11, 2007 Share Posted May 11, 2007 I have 3 points on my licence (just about to be joined by a lot more - 91.37mph in a 60 mph zone last weekend) which are 3 years and 8 months old. They are the standard SP30 speed camera jobs. Can I get them removed now (before I go to court) or do they have to stay on for 4 or 5 years? I quite like the idea of going to court with a "clean" licence. I know the magistrates will have access to my record, but I would still like to go in with nothing physically on the licence if I can. The nice Policeman said he would state on his report that the road was dry and clear, that it was sunny and there was no other traffic, which he said might help. In the "good old days" when PC Plod would whack you round the head if you were caught scrumping apples todays more "modern" police are beset with targets. So when Plod goes out with his gun he's expected to come back with a nice lot of pending prosecutions: being sensible doesn't count. Standard 3 pointers count for maybe 1 nick on his trunchoen & being 30mph over counts for more nicks. He's just doing his job & he has to measure up like any other government employee. 10 years of rigid socialist dogma has taken away any discretion as his job & promotion prospects depend on results. The public therfore have less respect for the police. Target obsessed police & health care workers now see their job as meeting targets. "The operation was a great success as I met my targets. Or it used to be! And, to make matters worse, two on coming cars had flashed me and I was just thinking "Something wrong with the car?", "Caterham fans?", "SPEED TRAP!!!!!!!! - s-h- i- t policeman on verge in the distance - toooooooooo laaaate". Unfortunately, gives no protection against hand-held hair-dryers. For this you would need a laser detector, but may well have been caught as soon as you were in the line of sight (Also illegal ??). SLR69 Posted May 12, 2007 Share Posted May 12, 2007 Thought that you might like to know what you would get for 91.37 mph in Guernsey(Channel Islands) where the speed limits are 25mph in town and 35 mph elsewhere - it would be a 1 year ban and a £400 fine. This guys case was dropped as they were not prepared to produce the evidence of accuracy in court. Basically he used the Freedom of Information Act to find out the distances over which the tripod mounted speed camera was accurrate over. CPS decided to drop the case on cost grounds. jeremybu Posted May 12, 2007 Share Posted May 12, 2007 The points count for 3 years, you can have the conviction removed from the licence after 4 years, but is still a current conviction under the Rehabilitation of Offenders Act for 5 years so needs to be disclosed (to insurance companies for example) for that period. I was done at 371 metres and it is written on the prosecution slip the copper gave me! Surely at 371 metres they cannot be accurate? I was only 1mph over 30mph over the top. Is it worth getting legal or motoring organisation advice? I don't mind 3 points and £60 quid, but 6 points a huge fine and a possible ban for being 31mph over the top hurts.
